As per 410.116(B), if thermal insulation is installed above a recessed luminaire or within 3 in. of the recessed luminaires' enclosure, wiring compartment, ballast, transformer, LED driver, or power supply, the luminaire must be identified as Type IC for insulation contact. If the insulation is installed greater than 3 in. away this NEC requirement would not apply.
