The first Code violation I would like to point out in this installation is the improper type of cover installed on the receptacle. For 15A or 20A receptacles installed in wet locations, Sec. 406.9(B)(1) requires a cover that is weatherproof, even when the cord is plugged in. The cover must also be a listed, extra-duty type of cover. This one obviously is not the correct type.
The next problem is the use of flexible cord in this location. A close inspection of this cord indicates it is all dried out, cracked, and weather-worn. Section 400.3 very simply and clearly states that flexible cords and their associated fittings must be suitable for the conditions of use. This cord cap and cord do not appear to be rated for this outdoor wet location, nor to the direct rays of the sun.
Section 400.8(7) strictly prohibits flexible cords or cables from being used where subject to physical damage. This cord is definitely in harm’s way where it emerges from the ground. No amount of duct tape wrapped around the cord could provide the type of protection needed for this cord.
