Louisiana Electrical Contractor Sues Over Non-Payment in Subcontract

An electrical construction services company in Louisiana is suing two other contractors, claiming that it hasn't been paid for work completed on a joint project.

Hi-Tech Electric, Inc. filed a lawsuit against T&B Construction and Electrical Services, Inc. on July 29 in a U.S. District Court, citing bad faith, breach of contract and willful failure or refusal to process payment due.

According to a report from The Louisiana Record, Hi-Tech Electric and T&B Construction entered into a teaming agreement to prepare and submit to Clark/McCarthy Healthcare Partners to cooperatively do some electrical work. In January of 2012, CMHP entered into a written subcontract with T&B to which T&B agreed to furnish certain electrical work for their Pan American Building.

Hi-Tech Electric and T&B drew up a MoU addressing the work to be done by each party and the manner in which payments would be made on the project – particularly on the Pan Am project, according to the lawsuit. Hi-Tech Electric claims that it is owed $556,070.20 for that work and that CMHP has not released payment to T&B Construction/Hi-Tech Electric on the Pan Am Project due to the actions and/or inactions of T&B.
